Terms of Service
1) Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of the Harvey Goodman Training Assistant (“Harvey Bot”), including web chat, SMS, and any related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) Who may use the Service
The Service is intended for use by authorized Harvey Goodman Realtor agents and staff. You agree that you will not share access to the Service in a way that allows unauthorized users to use it.
3) Purpose of the Service
Harvey Bot provides training-oriented guidance and references on topics such as real estate practices, contracts, professional standards, and ethical rules. The Service is designed to help users find information faster and improve consistency in training.
4) User responsibilities
- Use good judgment: Verify critical details and follow brokerage policies and applicable laws.
- No sensitive data: Do not submit Social Security numbers, bank/financial account details, client ID numbers, or other highly sensitive personal information.
- No prohibited content: Do not use the Service for harassment, unlawful activity, or to generate misleading content.
- Compliance: You are responsible for complying with all laws, rules, MLS/association policies, and brokerage procedures.
5) SMS terms (consent, STOP/HELP, and message rates)
If you use Harvey Bot via SMS, you consent to receive text messages related to training and support. Message frequency varies. Standard message and data rates may apply.
- Opt-in: You may opt in by texting the designated Harvey Bot number or by providing consent during onboarding/training.

HELPfor support information. - No sharing/selling: Mobile information will not be shared with third parties for marketing/promotional purposes.
6) Service availability and changes
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We do not guarantee that the Service will be available at all times or that it will be error-free.
7) Accuracy and limitations
The Service may produce incomplete, outdated, or incorrect responses. You are responsible for verifying outputs before relying on them, especially for client-facing decisions or compliance-sensitive matters.
8) Intellectual property
The Service, including its design, software, and content (excluding user-submitted messages), is owned by Harvey Goodman Realtor or its licensors and is protected by applicable intellectual property laws. You may use the Service only as allowed by these Terms.
9) User content
You retain any rights you have in the content you send to the Service (“User Content”). You grant us a limited right to process User Content to operate the Service, generate responses, maintain security, and improve training operations. For more information, see our Privacy Policy.
10) Termination
We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, used the Service in a way that could create risk for the brokerage, or for operational/security reasons.
11) Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12) Limitation of liability
To the maximum extent permitted by law, Harvey Goodman Realtor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. In no event will our aggregate liability for any claim exceed $100.
13) Governing law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict of law principles, except where applicable law requires otherwise.
14) Changes to these Terms
We may update these Terms from time to time. We will revise the effective date above and, where appropriate, provide additional notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
